These Terms and Conditions govern your use of themarketingdeli.com and all services offered by The Marketing Deli ("we," "us," or "our"), including the monthly membership community and all done-for-you marketing services. By accessing our website or purchasing any product or service, you agree to these terms in full.

1. About The Marketing Deli

The Marketing Deli is a private Done With You marketing community and service agency for real estate agents. We offer a monthly membership at $97/month that provides access to our community, marketing system, coaching, and resources, as well as individual done-for-you marketing services available for purchase separately.

2. Eligibility

By using our services, you represent that you are at least 18 years of age, have the legal authority to enter into this agreement, and are using our services for lawful business purposes. Our services are intended for real estate professionals and business owners.

3. Membership Terms

Subscription: The Marketing Deli membership is billed at $97 per month on a recurring basis. Your membership begins on the date of your first payment and renews automatically on the same date each month.

Cancellation: You may cancel your membership at any time by contacting us at [email protected] or through your account settings. Cancellation takes effect at the end of your current billing period. You will retain access to the membership community until that date.

Refund Policy — Membership: All membership payments are non-refundable. We do not offer refunds or credits for partial months, unused periods, or any membership fees already charged. You may cancel at any time to prevent future charges, but charges already processed will not be reversed.

Access: Upon joining, you will receive access to The Marketing Deli community platform, the Marketing Deli system content, and any bonuses or resources available to members at the time of your subscription, including the Price Reduced Home Buyer Ad Campaign available on day one.

Changes to Membership: We reserve the right to modify the features, content, or pricing of the membership at any time. We will provide reasonable notice of any price changes. Continued use of the membership after a price change constitutes acceptance of the new price.

4. Done-For-You Service Orders

Service Agreements: When you purchase a done-for-you service from The Marketing Deli, you are entering into a service agreement for the specific deliverable described at the time of purchase. All service descriptions, pricing, and delivery timelines are outlined on our services menu at themarketingdeli.com/the-menu.

Refund Policy — Services: All done-for-you service orders are non-refundable. Work begins upon receipt of payment and confirmation of your order details. Because our team allocates time and resources to your project immediately upon order, we are unable to issue refunds once an order has been placed regardless of whether work has been delivered.

Your Responsibilities: To complete your service order, we may require information, assets, access, or approvals from you. Delays caused by your failure to provide required information in a timely manner may extend delivery timelines. We are not responsible for delays resulting from incomplete or late submission of required materials.

Delivery Timelines: Estimated delivery timelines are provided in good faith and represent our standard turnaround times. They are not guaranteed and may vary based on project complexity and current workload. We will communicate any significant delays promptly.

Revisions: Unless otherwise stated at the time of purchase, service orders include one round of revisions based on your original brief. Requests that fall outside the original scope may be subject to additional charges.

5. Payment Terms

All payments are processed securely through Stripe. By providing your payment information, you authorize The Marketing Deli to charge your payment method for the amounts described at checkout.

For monthly memberships, you authorize recurring charges on the same date each month until you cancel. It is your responsibility to ensure your payment information remains current. If a payment fails, we reserve the right to suspend or terminate your access until payment is resolved.

All prices are listed in US dollars. International customers are responsible for any currency conversion fees or charges imposed by their financial institution.

6. Intellectual Property

All content provided through The Marketing Deli membership and services — including but not limited to marketing systems, ad campaigns, copy, templates, guides, and community content — is the intellectual property of The Marketing Deli and Harrison Smith.

You are granted a limited, non-exclusive, non-transferable license to use the materials provided for your own real estate business. You may not reproduce, distribute, resell, or share our proprietary content with third parties without express written permission.

The ad campaign and marketing assets provided to you as part of our done-for-you services are created for your use and become your property upon delivery and full payment.

7. Results Disclaimer

The Marketing Deli provides marketing education, tools, systems, and services. We make no guarantee of specific results including but not limited to lead volume, conversion rates, gross commission income, or business growth.

Results shared in our marketing materials — including agent testimonials, GCI figures, and lead cost data — represent real results achieved by real agents but are not typical. Individual results will vary based on market conditions, effort, experience, budget, and implementation.

Your success depends on your own effort, commitment, and ability to implement the system provided. The Marketing Deli is not responsible for your results or lack thereof.

8. Acceptable Use

By using our services and community, you agree not to share, distribute, or resell any content, systems, or materials provided through your membership to third parties. You agree not to use our community platform to spam, harass, or solicit other members. You agree not to misrepresent your affiliation with The Marketing Deli. You agree to conduct yourself professionally within the community and in any interactions with our team.

We reserve the right to terminate your membership without refund if you violate these acceptable use terms.

9. Third-Party Platforms

Our services involve the use of third-party platforms including but not limited to Facebook, Google, GoHighLevel, Skool, and Stripe. Your use of these platforms is subject to their own terms of service and privacy policies. We are not responsible for changes to third-party platforms, their policies, or any interruptions to their services that may affect your use of our products.

Facebook advertising results are subject to Meta's advertising policies and algorithm changes. We make no guarantees regarding ad performance, reach, or cost per lead on any third-party platform.

10. Limitation of Liability

To the fullest extent permitted by applicable law, The Marketing Deli and Harrison Smith shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to lost profits, lost data, or business interruption.

Our total liability to you for any claim arising from your use of our services shall not exceed the total amount you paid to us in the 90 days preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless The Marketing Deli, Harrison Smith, and any team members from any claims, damages, losses, or expenses including reasonable legal fees arising from your use of our services, your violation of these terms, or your violation of any third-party rights.

12. Governing Law

These Terms and Conditions are governed by the laws of the State of Maine, United States, without regard to its conflict of law provisions. Any disputes arising from these terms shall be resolved in the courts of the State of Maine.

13. Dispute Resolution

Before initiating any legal action, you agree to contact us at [email protected] and provide written notice of your dispute. We will make a good faith effort to resolve the dispute within 30 days of receiving notice. If the dispute cannot be resolved informally, it shall be submitted to binding arbitration in the State of Maine in accordance with the rules of the American Arbitration Association.

14. Changes to These Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be posted on this page with an updated date. Continued use of our services after changes are posted constitutes your acceptance of the updated terms. We encourage you to review this page periodically.

15. Severability

If any provision of these Terms and Conditions is found to be unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms and Conditions, together with our Privacy Policy, constitute the entire agreement between you and The Marketing Deli regarding your use of our services and supersede any prior agreements or understandings.
